An Overview of Deferred Action for Parents of Americans and Lawful Permanent Residents

Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) was a planned United States policy that was initially designed to work in conjunction with Deferred Action for Childhood Arrivals (DACA). In November of 2014, President Barack Obama announced the DAPA program. Here is a brief explanation of how DAPA was supposed to work:

• Under the Executive Order signed by President Obama, DAPA would grant deferred action (temporary protection against deportation) to some undocumented immigrants. To qualify for DAPA, an applicant would have to prove that they were residing in the U.S. since at least 2010 and that they have children who are American citizens or lawful permanent residents. DAPA would have provided a three-year renewable work permit to qualifying immigrants.

To be clear, DAPA never went into effect. Shortly after the policy was announced, several states filed a lawsuit to block Deferred Action for Parents of Americans and Lawful Permanent Residents. After a complicated procedural process, DAPA got hung up in the courts. Eventually, in 2017, the Trump Administration fully rescinded the DAPA order. In effect, this means that the policy as initially envisioned will not go into place. Further legislative action or executive action is needed to move the process forward.

Where Does DAPA Stand in 2021 and What Does the Future Look Like?

As of early 2021, the DAPA program is not in place. The federal government is not accepting DAPA applications and there are no pending court decisions that could change things. That being said, the Biden Administration has expressed interest in reviving DAPA in some form. There is some hope for the future. Still, there is a long way to go. Whether DAPA is enacted and how exactly a reinstated DAPA program would work remains to be seen.
