An Overview of Deferred Action for Childhood Arrivals

Created by an Executive Order under the Obama Administration in June of 2012, Deferred Action for Childhood Arrivals (DACA) is a government policy that allows some undocumented immigrants who were brought into the United States as children to obtain temporary legal status. To be eligible for the DACA program, an applicant must be able to satisfy the following four standards:

1. They have lived in the United States since at least June of 2007;
2. They first arrived in America before they turned 16 years old;
3. They have obtained a high school diploma, GED, or are still on track to do so; and
4. They have no history of felony offenses or violent misdemeanors. 

When granted, DACA allows a person brought to the United States as a child a work permit and deferred action against deportation. DACA protections are granted on a two-year renewable basis. A DACA application must be renewed at the appropriate time, and the failure to do so will cause protections to lapse.
